The Terms of Service (“Terms”), including the Privacy Policy, is an agreement between you and Fitimage (collectively referred to as “us”, “our”, or “we”). When you use https://www.fitimage.com (the “Site”) you agree to Terms of Service.

PLEASE READ THE FOLLOWING TERMS OF SERVICE CAREFULLY. BY VISITING, BROWSING, ACCESSING OR USING THE SERVICE OR SITE OR SIGNING UP FOR AN ACCOUNT, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS, INCLUDING PRIVACY POLICY (COLLECTIVELY, THESE “TERMS”).

Fitimage Service Overview.

Fitimage site is a software-as-a-service product that provides access to Calendars with workouts created by Fitimage. The information on the website is provided for educational purposes only. The Site is meant to assist you with your fitness goal from a high level, generalized perspective. Fitimage is not a certified personal trainer and/or nutritionist, therefore the information on the site should not be taken as a specific instruction. Please consult with your medical doctor or other professional before using the service.

Eligibility.

By agreeing to the terms of service you warrant to us: (1) that you are at least eighteen years of age, (2) that you have not been previously removed/suspended from the site, (3) you have no intend to sell, lend, rent, sub-license or distribute Fitimage services or any intellectual property or make the Fitimage services available to others.

Payment.

Access to certain features of the Site, may require you to pay fees. Fees are payable based on the frequency identified in the selected subscription plan. Upon renewal of Customer’s subscription, customer authorizes Fitimage and our third party payment processors to charge on-file payment method for the same subscription plan at the current subscription fee plus any applicable taxes. The site fees do not include Fitimage third party payment processors for which Customer will be solely responsible.

Accounts and Registration.

You must register for an account in order to access some parts of the site. When you register you will need to provide us some information about yourself. You agree that the information you provide to us is accurate. As a part of the registration you might be asked to create a password. You are solely responsible for maintaining the confidentiality of your account and password.

You will not use our copyrights or Trademarks without our prior written permission.

Mobile Device Usage.

The site can be accessed through mobile device browser. Customer is responsible for all costs associated with mobile device usage, including data usage fees and other fees.

Termination of Use; Discontinuation and Modification of the Service.

If you violate any provision of these Terms, we hold the right to terminate or suspend the service. Additionally, we may terminate your user account on the Service or suspend or terminate your access to the Service at any time, with or without notice. We also reserve the right to modify or discontinue the Service at any time without notice. You may terminate your account at any time by doing so in Subscriptions section of your Profile. If you terminate your account, you will still have access to the website for the remaining period of time based on your subscription. For immediate termination please contact feedback@Fitimage.com.

Changes to the Terms.

We reserve the right to change these Terms at any time. Please check these Terms periodically for changes. In the event that a change to these Terms materially modifies your rights or obligations, we will make reasonable efforts to notify you of such change. We may provide notice through the Service, by sending an email to any address you may have used to register for an account, or through other mechanisms.

The Service is owned and operated by Fitimage.

No Warranties.

The site, service and all materials available through the site and service are provided “AS IS” and on an “AS AVAILABLE” basis, without warranty or condition of any kind. You understand and agree that you use the site at your own risk.

By using the site you warrant that you are not located in a country that is subject to a U.S. government embargo, or that has been designated by the U.S. government as a terrorist supporting country.

These Terms shall be governed by the laws of the State of California without regard to conflict of law principles.
